High Court blocked four Oyo State Government bank accounts, ₦3.4 billion debt

High Court blocked four Oyo State Government bank accounts, ₦3.4 billion debt

High Court blocked four Oyo State Government bank accounts, ₦3.4 billion debt

One of the High Court sited in the Federal Capital Territory (FCT) of Nigeria in Abuja has blocked the Oyo State government bank account in precise four banks with  over ₦3,374,889,425.60, debt

A Justice, Justice A. O. Ebong, on its ruling on a motion ex-parte for an arrogate order, issued an order attaching funds to the credit of the Oyo state government bank account in First Bank of Nigeria  Plc, United Bank for Africa Plc. UBA, Wema Bank Plc., and Zenith Bank Plc.

Justice Ebong ordered the banks to show cause why the order should not be made absolute. The ruling on the motion marked FCT/HC/BW/M/238/2023 was delivered by the judge on the 2nd of March, and a certified true copy (CTC) was sighted on Sunday in Abuja (FCT).

These funds, according to the court filings are to settle the outstanding balance of 3,374,889,425.60 from the judgement debt owed some of the former local government chairpersons and councillors sacked on 29 May 2019, before the end of their tenure by Governor Seyi Makinde of Oyo State.

“An garnishees order nisi is hereby granted to attach the judgement debtors’ accounts with garnishees Nos. 1 to 4 in the motion ex-parte, for the purpose of settling the judgement debt outstanding in the sum of 3,374,889,425.60, as awarded by the Supreme Court and conceded by the judgement debtors in Exhibit 11 attached to the applicant’s motion,” the ruling reads.

It was gathered that the judgement creditors have since effected service of copies of the order on the judgement debtors, as ordered by the court.

Listed as judgement debtors with the Oyo State Governor are the state’s attorney general, the commissioner for local government and chieftaincy affairs, the accountant general, the house of assembly, its speaker, and the Oyo State Independent Electoral Commission (OYSIEC).

The ex-chairpersons and councillors were elected in the election conducted by OYSIEC on March 12, 2018, for a three-year term.

It is keen that Makinde, who took office on 29 May 2019 had planned to sack them, they sued before the High Court of Oyo State to challenge the constitutionality of Sections 11 and 12 of the Oyo State Local Government Law 2001, which empowered the governor and the House of Assembly to dissolve LG executives in the state.

The Oyo State High Court, in its judgement on 6 May 2019, declared Sections 11 and 12 of the state’s Local Government Law 2001 as unconstitutional on the grounds that they violated Section 7(1) of the Constitution.

Despite the subsistence of the judgement, Makinde sacked the chairpersons and councillors on 29 May 2019 and subsequently appealed the judgement.

In its judgement on 7 May 2021, a five-member panel of the Supreme Court presided over by a Justice, Justice Kudirat Kekere-Ekun allowed the appeal marked SC/CV/556/2020 and set aside the decision of the Court of Appeal.

The court, which awarded a cost of N20 million against Mr Makinde, ordered that the ex-chairpersons and councillors, who were unlawfully sacked by the state governor, to pay their salaries and allowances from 29 May 2019 to 11 May 2021, when their tenure ought to have expired.

In the lead judgement by Justice Ejembi Eko, the Supreme Court came down hard on Makinde, whom it found to have acted arbitrarily and undemocratic.

The Court of Appeal, in its judgement on 15 July 2020, set aside the judgement of the High Court, a decision the affected officials appealed at the Supreme Court.

“I will not conclude this appeal without commenting on the disturbing ugly face of impunity displayed by the Governor of Oyo State (1st respondent herein) on 29 May 2019, tantamounting to executive lawlessness, outrightly and vehemently condemned by this court in the case of the Military Governor of Lagos State v. Ojukwu.” Justice Eko said

Justice Eko noted that, even before appealing the High Court judgement, Makinde, on 29 May 2019, “issued imperial directives dissolving all democratically elected local government councils in Oyo State in spite of the subsisting judgement of the Oyo State High Court in the suit No. 1/347/2017.

“Series of applications were filed by the judgment creditors, the present appellants, to restrain, particularly the 1st respondent (the Governor), from embarking on the self-help designed to contemptuously frustrate the judgment of the High Court.”

“He was not dissuaded. He proceeded in his imperial omnipotency to continue in his untrammelled, albeit invidious contemptuous, disregard of subsisting judgment of the High Court.

“It is unthinkable that a democratically elected governor would embark on these unwholesome undemocratic tendencies. These tendencies no doubt endanger democracy and the rule of law.”

“It is almost becoming universal phenomena that the democratically elected Governors have constituted themselves into a specie most dangerous to democracy in this country.”

“They disdainfully disregard and disrupt democratically elected Local Government Councils and appoint their lackeys as caretaker committees to run affairs of Local Governments.”

According to EFCC insiders, other defendants in the case are Victor Briggs, Abiye Memnere, David Mbanefo, Atlantic Energy Brass Development Limited and Atlantic Energy Drilling Concepts Limited.

The anti-corruption agency detained Omokore over the weekend over allegations that he connived with former Nigerian oil minister, Diezani Alison-Madueke to steal billions of dollars in shady oil transactions.

Omokore is the chairman and founder of Energy Resources Group (ERG), one of Nigeria’s largest privately-held conglomerates. ERG has interests in oil trading and exploration, haulage services, steel, dredging engineering and property development.

Meanwhile, the federal government has succeeded in compelling Omokore, to cough up $14m (roughly N2.8 billion). The figure comes from the crude oil royalties his company failed to remit to the federal treasury. Insider sources said the funds were supposed to have been paid between 2011 and 2012 by Atlantic Energy which was awarded oil assets by the Goodluck Jonathan government shortly after it was incorporated in 2010.

The money was finally paid into the federal government’s account with JP Morgan Chase on January 29 after the Economic and Financial Crimes Commission (EFCC) began to investigate the company.

We never supported Niger Delta Avengers - MASSOB faction

We never supported Niger Delta Avengers - MASSOB faction

– Factional differences responsible for initial support for Avengers

 – Another faction says it is the real MASSOB group with an authentic leader

 – Appeals to Nigerians over the recent violent actions carried out by the militants The Niger Delta Avengers have lost the backing of the Movement for the Actualisation of the Sovereign State of Biafra (MASSOB).

This latest decision by the group is coming after they had initially confessed their support for the Niger Delta group following the ultimatum given to seven governors to release pro-Biafra agitators who were detained in their respective states.

But, rising from a meeting in Aba, Abia state on Thursday, the Chief Ralph Uwazuruike-led faction of MASSOB changed its mind on the decision of the Uchenna Madu-led faction of the group.

“It will, therefore, be out of place for any genuine MASSOB member to say he is supporting what the NDA is doing in the Niger Delta region -destroying oil facilities which were built with the peoples’ money.”

According to Okereafor, no true MASSOB member would want to align with the Avengers group which he believes has destruction as its mission.

MASSOB backs Niger Delta Avengers

He added: “By accepting to dialogue with the federal government, it means NDA leaders have agreed to dialogue away the future of their children and MASSOB should have nothing to do with such a group because we believe in the sanctity of Biafra which will be achieved through peaceful means.

“We could have welcomed them if they had renounced violence, do away with their plans to dialogue with anybody and demanded a country of their own.”

MASSOB’s spokesperson further informed that those who claimed to be members of the pro-Biafran group and are supporting militants’ violent actions are no longer members of the movement.

He therefore appealed to members of the public to discountenance any claim made by anybody on behalf of the group, insisting that the group’s authentic leader remains Solomon Chukwu, who was reportedly carefully chosen by members last year.

Chief Solomon Chukwu, the leader of MASSOB has also explained the relationship between Biafra and the Niger Delta Avengers.

Chukwu was speaking through his national director of information, Sunday Okereafor, the Punch reports.

The Presidency had, in a statement, indicated that the President would during the visit to the United Kingdom, see an Ear, Nose and Throat specialist for a persistent ear infection.

The 10-day holiday ended on Wednesday and the President is expected to return to Abuja today, June 16.

A source in the Presidency, who spoke on condition of anonymity, said on Wednesday, June 15, that arrangements had been put in place to receive the President, who is due back in the country on Thursday.

“He is expected back on Thursday (today). We are in touch with him. As of today (Wednesday), we have not been told that there is any change in arrangement,” the source said.

The Presidency had, on Monday, June 13, released photographs of the visit of the Archbishop of Canterbury, Most Revd, Justin Welby, to Buhari in London.

Welby, who presented a souvenir to the President, was in company with Nigeria-born Secretary-General of Anglican Communion Worldwide, Most Revd Idowu Fearon.

Buhari had so far embarked on holiday twice this year. The President had earlier embarked on a six-day holiday between February 5 and 10, 2016.

Like the case of the second visit, Buhari remained in London throughout the first holiday. He had earlier granted an interview where he said the doctors he had been consulting since the 1970s were based in London.

Buhari had, before leaving the country, written to the National Assembly to inform the federal lawmakers of his medical trip.

He had indicated in the letter that Vice-President Yemi Osinbajo would perform the duties of the President while he would be away.

Meanwhile, the Presidency on Wednesday, June 15, commended the House of Representatives for giving prompt action to two executive bills that scaled through second reading.

This was contained in a statement on Wednesday in Abuja by the Special Assistant to the President on National Assembly Matters (House of Reps), Alhaji Suleiman Kawu.

“We wish to thank the House of Representatives, under the leadership of Speaker Yakubu Dogara, for passing two of our bills today, June 15, 2016,” Kawu said in the statement.

“The other is a Bill for an Act to Provide for the Domestication and Enforcement in Nigeria of the Avoidance of Double Taxation Agreement between the Federal Republic of Nigeria and the Republic of South Korea and for Other Related Matters.”
“One is a Bill for an Act to Provide for the Domestication and Enforcement in Nigeria of the Avoidance of Double Taxation Agreement between the Federal Republic of Nigeria and the Kingdom of Spain.

According to the statement, the action has shown that the House is solidly behind the executive on its numerous policies aimed at making Nigeria better.

“We hope you will also pass our other bills that are currently before the House with the same zeal that you passed these two,” the Presidency stated.

President Buhari  has assured Nigerians that his administration will soon put smiles on their faces by rehabilitating the economy and creating more jobs.

The President said this in his address delivered at the swearing-in ceremony of the 2016 Batch ‘A’ stream II at the National Youth Service Corps permanent orientation camp, Ede in Osun state on Wednesday.

Punch reports that the address was read by the state deputy governor, Mrs Titi Laoye-Tomori.

He said the collapse of industries had worsened the unemployment rate because millions of unemployed youths were now struggling  to get  very limited government jobs.

Buhari, who lamented the poor state of the economy inherited by his administration, said he was bent on recovering the nation’s stolen wealth and used them to rebuild the economy.

He said: “The collapse of industries and the eventual overbearing pressure to grab public jobs has put the nation in a sorry economic state of unemployment. Thousands of graduates from the higher institutions of learning get frustrated daily, as they search for non-existing jobs.

“That is why this administration is anxious to recover illicit wealth to channel  them into enduring economic rehabilitation. Very soon, the gloomy situation would be reversed to put smiles on the faces of young people.”

The President advised the youths to shun kidnapping, drug peddling and other criminal activities which could jeopardise their future.

The Coordinator of the NYSC in Osun state, Mrs Regina Iluebbey, said the scheme had adjusted its cooking arrangements to cater for Muslim corpers, during the Ramadan.

She said the scheme would start preparing  saur and Iftar  for Muslim  corps members for them to participate in the Ramadan.

She  said: “The camp kitchen would double its efforts in ensuring that the corps members participating in the ongoing Ramadan are  served at saur  (midnight) and Iftar (evening) time throughout their stay in camp.”

She added that the NYSC reduced the usual 21 days orientation camp to 17 days due to the large number of students who graduate annually, adding that the cut in days was important in order to cover the salient orientation camp exercises.

Iluebbey added that the camp registered 1,416 male corps members and 799 female corpers from the 36  of the federation, including the Federal Capital Territory.

Also, the Niger State Governor, Abubakar Bello, on Wednesday said there was no wisdom in scrapping the NYSC  since the primary objective of the programme was still relevant in the nation.

Bello, who said that the NYSC was still relevant as a vehicle for national unity, asked the Federal Government to reinvigorate the scheme rather than scrap it.

The governor said this at the formal opening ceremony of the 2016 Batch ‘A’ (Stream Two) orientation course and swearing-in ceremony of 2,001 corps members deployed in the state.

The governor, however, said in the NYSC implementation processes, “we need to be more innovative and we need to reinvigorate the programme by giving the youths the opportunity to learn higher ideals and prepare them for the reality of life after death.”

Earlier, the NYSC Niger State Coordinator, Mrs. Bolade Loto, said that a total of 2,001 corps members were registered in the Stream B, adding that they had so far exhibited high level of discipline, commitment and loyalty since they arrived the camp.

In Owerri, the Imo State Governor, Rochas Okorocha, advised corps members posted  to the state to ensure active participation in the empowerment programme so as to enable them to stand on their own as entrepreneurs instead of job seekers after the completion  of their service year.

Okorocha gave the advice while declaring open, the 2016  Batch “A” (Stream 11) 1,800 corps members posted to the state after the State  Chief Judge, Justice  Paschal Nnadi represented by Justice  Kenneth O.  Ojiako of the state judiciary administered the oath on the corpers.

He said: “The NYSC orientation programme provides a veritable  platform for you to be trained mentally and physically and this is done to enable you to face  the rigours and challenges of the service year as well as the post-service year.”

Okorocha, who was represented by his deputy, Prince Eze Madumere, restated his determination to make the NYSC Permanent Orientation camp at Eziama Obaire, the best in the country.

He also announced the immediate restoration of  regular supply of water, electricity and functional vehicles in the orientation  camp for the comfort of the corps  members and enhancement of the operation of the NYSC officials in the state.

The state Coordinator of the NYSC, Mr.  Fasanu Isaac, had earlier commended Okorocha for his sustained support to the scheme as well as his resolution to make the orientation camp second to none in the country.
